Customer's Guide To Submitting A Claim

What You Should Do

We have prepared this guide to provide you with detailed information on our claims handling process. It aims to assist you in the event that you discover damages or loss to your goods upon receipt. Our primary goal is to ensure that your claim is handled in a straightforward and efficient manner, while adhering to relevant legislation, international conventions, and the terms and conditions agreed upon. 

Notification

If damage or loss to your goods is apparent upon receipt, you should immediately stop all unstuffing or unpacking activities upon discovery and notify the legal SKCL office handling your shipment without delay. As a general guide, a formal notice should be provided in writing to SEKO within 3 calendar days from the time of delivery.

Follow-Up Actions

Claims submitted will be acknowledged within 14 days. Upon receipt of your claim notification, we will carry out a thorough investigation of your claim. Once liability has been established, SEKO will review and advise of any further documentation or of settlement within the 120 days as required. 

Inspection of Affected Goods

SEKO Container Lines Pte Ltd (SKCL) will appoint a surveyor who will make arrangements directly to conduct an independent inspection. Failure to keep all product and packaging of damaged product, unless otherwise instructed in writing by SKCL, may result in non-payment of claim.

You should also inform your cargo underwriters on the loss or damage of the cargo if you have insured, as they probably need to be involved and appoint a surveyor for a joint inspection.

Settlement

In the event that a settlement is reached between you and SKCL, you are required to sign a claim settlement & discharge document and/or assignment of rights document (in cases where there is a potential recovery action against a third party) to confirm that any claim payment made by SKCL shall constitute full and final settlement of your claim without admission of liability whatsoever. 

Documents To Submit

When submitting a claim, please provide the following supporting documents, if applicable. 

  1. A Claim form asserting the SEKO Container Lines Bill of Lading number, dollar value of loss and description of loss.
  2. Legible copy of the bill of lading, sea waybill (both front and overleaf sides) issued by SEKO Container Lines. 
  3. Survey or any reports documenting the affected goods. 
  4. Commercial invoice asserting the dollar value loss.
  5. Any receipts for salvage or repairs.
  6. Destruction and disposal certificates if the damaged goods have been destroyed and disposed. 
  7. Other documents, where applicable
